There has been some confusion surrounding the new hiring rules and what is now permitted. Here, we summarise the most important questions on the new hiring rules.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">In which cases is hiring from a temporary employment agency still possible?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Hiring temps for fixed-term positions is still lawful, just as it was before the legislative amendments. For example, you can hire a temp for periods of sickness, leave, holidays, and other absences. You can also hire a temp whilst you are working on filling a permanent position.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is still possible to hire personnel with <em>specialist expertise<\/em> to help with <em>advice or consultancy services <\/em>At <em>clearly defined project<\/em>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The hiring of personnel is also permitted by agreement with the shop stewards who represent a majority of the employee category to which the hiring applies, in companies bound by a collective agreement concluded with a trade union with the right to be consulted (more than 10,000 members \u2013 i.e. LO, YS, Fellesforbundet, Finansforbundet, etc.).<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"683\" src=\"https:\/\/www.nokkelpersonell.no\/wp-content\/uploads\/2022\/01\/pexels-vanessa-garcia-6325967-1024x683.jpg\" alt=\"\" class=\"wp-image-497\" srcset=\"https:\/\/www.nokkelpersonell.no\/wp-content\/uploads\/2022\/01\/pexels-vanessa-garcia-6325967-1024x683.jpg 1024w, https:\/\/www.nokkelpersonell.no\/wp-content\/uploads\/2022\/01\/pexels-vanessa-garcia-6325967-300x200.jpg 300w, https:\/\/www.nokkelpersonell.no\/wp-content\/uploads\/2022\/01\/pexels-vanessa-garcia-6325967-768x512.jpg 768w, https:\/\/www.nokkelpersonell.no\/wp-content\/uploads\/2022\/01\/pexels-vanessa-garcia-6325967-1536x1024.jpg 1536w, https:\/\/www.nokkelpersonell.no\/wp-content\/uploads\/2022\/01\/pexels-vanessa-garcia-6325967-2048x1365.jpg 2048w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<h3 class=\"wp-block-heading\">Who does the specialist exemption apply to?<\/h3>\n\n\n\n<h6 class=\"wp-block-heading\">Specialisation<\/h6>\n\n\n\n<p class=\"wp-block-paragraph\">The hired employees must have special expertise in a specific field. This can be both formal competency and\/or experience-based competency. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, the consultant may have several years of experience in procurement, or hold a formal degree in Supply Chain\/Logistics.<\/p>\n\n\n\n<h6 class=\"wp-block-heading\"><strong>Advisory and consulting services<\/strong>:<\/h6>\n\n\n\n<p class=\"wp-block-paragraph\">The engagement must pertain to professional expertise and specialised knowledge that the engaging party cannot be expected to possess themselves. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, you can hire:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A recruiter in connection with a staffing project<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2013 An IT consultant for the implementation of a new IT system<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An HR resource in connection with a restructuring process<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A communications advisor for a marketing campaign.<\/p>\n\n\n\n<h6 class=\"wp-block-heading\"><strong>Clearly defined project<\/strong>:<\/h6>\n\n\n\n<p class=\"wp-block-paragraph\">The project must be time-limited, and hiring external staff to alleviate the company during busier periods is not permitted. The maximum period for external hiring is 3 years. The project must be distinct from the organisation's day-to-day operations. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, an IT company cannot hire an IT consultant to help with the implementation of a new IT system; however, a company without IT expertise can hire an IT resource for the same purpose.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">There are certain situations where hiring through an agency is not permitted.<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A total ban on temporary employment applies to construction work on building sites throughout Oslo, Viken, and former Vestfold.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is not permitted to use temporary agency workers in cases where a company has a large need for labour for a limited period due to an increased workload within the organisation's normal business area.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Hiring for seasonal work is not permitted under the new rules that have come into effect, but an exception applies to agriculture.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"768\" height=\"1024\" src=\"https:\/\/www.nokkelpersonell.no\/wp-content\/uploads\/2021\/11\/DSCF7181-768x1024.jpg\" alt=\"\" class=\"wp-image-120\" srcset=\"https:\/\/www.nokkelpersonell.no\/wp-content\/uploads\/2021\/11\/DSCF7181-768x1024.jpg 768w, https:\/\/www.nokkelpersonell.no\/wp-content\/uploads\/2021\/11\/DSCF7181-225x300.jpg 225w, https:\/\/www.nokkelpersonell.no\/wp-content\/uploads\/2021\/11\/DSCF7181-1152x1536.jpg 1152w, https:\/\/www.nokkelpersonell.no\/wp-content\/uploads\/2021\/11\/DSCF7181-1536x2048.jpg 1536w, https:\/\/www.nokkelpersonell.no\/wp-content\/uploads\/2021\/11\/DSCF7181-scaled.jpg 1920w\" sizes=\"auto, (max-width: 768px) 100vw, 768px\" \/><\/figure>\n\n\n\n<h3 class=\"wp-block-heading\">Who is responsible and what are the consequences for illegal employment?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The hiring company is responsible for ensuring that the leasing is lawful. Unlawful leasing can have the following two consequences:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The hired-in employee can demand permanent employment with the hirer, or claim compensation if the employee has suffered a loss as a result. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2013 During inspections, the Labour Inspection Authority can order that the temporary employment be stopped.<\/p>","protected":false},"excerpt":{"rendered":"<p>Nye regler for innleie fra bemanningsforetak tr\u00e5dte i kraft 1. april 2023 med overgangsordninger til 1. juli 2023.
